CHENNAI, MARCH 9: The controversy surrounding the retirement of Justice C Shivappa of the Madras High Court appears to have been set at rest, with the Union Law Ministry sending him an official communication yesterday which said that the President had decided that his date of birth was December 11, 1936.

The bar and the bench of the Madras High Court will accord him a formal farewell tomorrow on his retirement.

According to sources close to him, a letter dated March 8, 1999, signed by the Law Secretary, reached him at his official residence here yesterday.

It was a reproduction of the fax message despatched to the court on March 4 by Union Law Minister M Thambidurai, sources said, adding that it said that the President had determined under Article 2173 of the Constitution that his age should be calculated on the basis that he was born on December 11, 1936, and not the same day in 1938, as given by him.

Shivappa had called on Chief Justice Dr A S Anand yesterday in New Delhi and returned last night.

Though he has said that the decision against him was justiciable, he is yet to decide whether to challenge it in a court.
