
ISLAMABAD, MAY 13: Former Pakistan premier Benazir Bhutto suffered a major set-back in her legal battle to save herself from conviction when the Supreme Court refused to accept her petition saying the quot;accused should surrender before filing the appealquot;.
The registrar of the apex court returned the appeal of Bhutto, filed by her counsel this morning, on technical grounds as the official in his brief order held that according to the Supreme Court8217;s rules 1980 the appellant must surrender before the court.
Bhutto8217;s lawyers had filed the appeal challenging the judgement of Lahore high court sentencing Bhutto along with her husband Asif Ali Zardari for five years in jail and disqualifying them from holding any public office for taking graft from a Swiss company in return to award of a government contract.
Benazir also had appealed for a full court hearing of the case as well as the interim suspension of her April 15 conviction, which will lift the threat of her arrest and allow her to take part in the legalbattle.
Bhutto8217;s lawyers said they were going to file an appeal against the decision of the registrar of the apex court.
Bhutto is currently outside the country and had declared that she would not return to Pakistan unless she got a relief from the apex court as authorities have already issued orders for her arrest.
