Relief to 13 cops in fake encounter case

In a temporary relief to 13 policemen summoned by a magistrate in connection with a fake encounter, a sessions court has stalled the execution of the order after the Delhi government opposed the direction.

Additional Sessions Judge B R Kedia had also issued a notice to the CBI for October 17, seeking its response on the government’s move.

Chief Metropolitan Magistrate Sanjeev Jain had on August 6 sought the presence of the policemen, including two sub-inspectors, after noting that the six-year-old act appeared to be a clear case of criminal conspiracy and murder.

On January 11, 2002, a Delhi Police special staff team led by sub-inspector Vinay Tyagi conducted a raid at the house of Rupender alias Upender at Pandav Nagar in East Delhi and allegedly killed him.

The CBI had registered a case against the accused in March 2003 but the agency had filed the closure report in the case for the want of a sanction from the Lt Governor.
