
CHANDIGARH, Dec 2: The Haryana Town and Country Planning Department has submitted two draft proposals to the Haryana government 8212; the first seeks to amend the Periphery Act to regularise construction in the UT periphery which falls within municipal limits of Kalka and Pinjore; the second concerns extending the lal dora of villages falling within the periphery of Chandigarh.
An amendment in the Periphery Act will be required to regularise structures falling within municipal limits and therefore governed by the Municipality Act. Says Town and Country Planning Director P. Raghuvendra Rao: quot;An overlapping of sorts is seen; some structures governed by the Municipality Act violate the Periphery Act.quot; This means that buildings sanctioned under the Municipality Act may nevertheless face threat of demolition as they violate the Periphery Act.
The draft proposals will have to be taken up at the next Vidhan Sabha session and approved by the legislature before change in the Periphery Act can be sought.
If the proposal is passed, nearly 2,500 structures falling within Pinjore and Kalka municipal limits but violating the Periphery Act will be regularised.
Regarding the extension of lal dora, Rao notes: quot;the lal dora was fixed some 50 years ago and has not been revised since. Meanwhile, village populations have increased manifold and the demand of land for houses is intense. Our proposal takes into consideration the genuine requirement of people in the villages falling in the City8217;s peripheryquot;.
The draft does not specify how far the boundaries are to be extended because, according to Rao, quot;it cannot be uniform for all villages. A survey will have to be carried out to determine how much extension is required in which villagequot;.
The Revenue Department which has the power to extend the lal dora will survey of the villages once the proposal is accepted. So far, the government has responded positively, says Rao.
