Nokia to replace cellphone for deficiency in service

The Consumer Disputes Redressal Forum has directed Nokia to repair the handset of a complainant without charging anything towards repair or replacement of its component. The forum also said that if the set is found to be non-repairable, the complainant shall be given a brand new cellphone of the same model and configuration free of cost.

Devinder Kumar Sharma had purchased a Nokia 5300 handset for Rs 7150 on July 20, 2007. It was alleged that within 20 days of its purchase, the handset developed problems in its normal functioning. It was given to the company for repair and was to be collected after some days.

It was averred that the handset was returned after an inordinate delay of 25 days. A few months later, when it again developed the same problems, the company refused to replace the handset.

In its reply, Nokia pleaded that when the handset was brought to them, they repaired the same and handed it over to the complainant. After the set was repaired, he never visited their office for his alleged complaint. The forum held that as the defect was recurring, proper service should have been provided to the complainant.
