HC allays police fear

  • The Bombay High Court today clarified that the evidence of police officers recorded in the ongoing Sessions Court inquiry into alleged fake encounters, cannot be used against them as admissible evidence in future proceedings.
  • The ruling comes in response to a clarification sought by Special Public Prosecutor Srikanth Bhat representing police officials deposing before Sessions Judge A S Aguiar.

The police had raised the similar query before the judge. However, as Aguiar had declined to clarify the issue, Bhat filed the application in the High Court.

The police feared that their evidence on oath in the Sessions Court will be used as readymade evidence against them by petitioners who have challenged the authenticity of the encounters.
