PATIALA, Nov 12: District and Sessions Judge K S Grewal here today adjourned hearing in the Jaswant Singh Khalra case to December 18 after the Central Bureau of Investigation counsel sought more time to give reply on the issue of supplementary challan regarding material eye-witness Kuldeep Singh.
As the court assembled for the hearing and the judge asked the Central Bureau of Investigation counsel to start the proceedings, counsel of the complainant objected and requested the judge to instruct the CBI counsel to give the reply on the issue of supplementary challan regarding material eye witness Kuldeep Singh’s statement first. On this, the CBI counsel sought more time and when the case was brought up for hearing again, the CBI counsel requested the court to grant more time to file its reply.
The judge adjourned the case to December 18.
All the accused in the case including Ashok Kumar DSP were present in the court.
It may be mentioned here that before this, the counsel for the complainant had filed an application under Sections 309 and 311 CrPC on August 12 in which they requested the court to direct the CBI to present the supplementary challan wherein the statement of material eye- witness Kuldeep Singh has been recorded.
The counsel pleaded in the application that after recording the statement of an eye-witness to the murder of Khalra, they had also recommended CRPF security for him. The statement of Kuldeep Singh, Sepicial Police Officer was recorded in March this year and he was provided Central Reserve Police Force(CRPF) security cover just three months back. They also pleaded that the Central Bureau of Investigation has stated before the supreme court that investigation was continuing in the abduction and murder of Khalra.
In the application, the counsel also prayed that despite the above facts, the CBI was not producing the relevant statement of the eye-witness in an effort to help the accused.
