
Bhubaneswar, Sept 28: The Additional Chief Judicial Magistrate (ACJM), Khurda, who is the designated CBI judge, has rejected the bail application of Advocate General Indrajit Ray in the alleged Anjana Mishra molestation case.
However, Ray immediately challenged the judgement of the ACJM in the sessions judge court and the case has been listed for hearing on Monday.Rejecting the bail petition, ACJM Manoranjan Hazra in his 17-page judgement observed, “The nature of the offence allegedly committed by the Advocate General, no doubt, is heinous in nature.” From the materials on record, there is reasonable ground to hold that there is prima facie case, he added.
The judgement said, “It is prima facie not believable that a lady would venture to foist an attempt to rape charge, unless a clearest motive is made out. The court will loose its credibility if it rebels against realism and the system of justice will breakdown,” the judgement said, adding that “a law court is not an unnatural world. The judicial instrument has public accountibility.”
Taking into account the above aspects, the ACJM said, he is not inclined to grant bail to the accused and the prayer for bail stands rejected.The judgement on the Advocate General’s bail application had been reserved by the ACJM on September 25 after hearing the arguments for two days of the two opposite parties.
