HC sets aside PSEB joint secy posting

Just a little over an year after Pavitar Pal Kaur was promoted as Punjab School Education Board’s joint secretary,a division bench of the Punjab and Haryana High Court set aside the order on Thursday. The directions came after petitions were filed by Janak Raj Mehrok and Sukhvinder Kaur Saroya against Punjab,the School Board and other respondents.

The bench was informed that Kaur’s earlier appointment as board secretary was set aside by a single judge on March 10,2009 holding it to be undesirable and unwarranted. The order was upheld by the Division Bench.

The petitioner said that even though her appointment as secretary was quashed,“Kaur was promoted to the post of Joint Secretary”.

The Bench was told that the respondent was not even eligible for promotion; and the relevant rules were amended to accommodate her.

The Bench remarked: “At the outset,we would like to record that the appointment of Pavitar Pal Kaur to the post of Secretary was under challenge. The court had set aside this appointment on the ground that she was facing criminal trial which was still pending…the Board should have restrained from appointing her as the Secretary”.
