The Allahabad High Court on Monday disposed of a petition of central ministers Jitin Prasada and RPN Singh,and others,seeking quashing of the FIR registered against them in connection with the alleged assault on a student leader during Congress leader Rahul Gandhis rally on November 14,2011.
A division bench of Justices Ravindra Singh and Anil Kumar Agarwal disposed of the petition after the state informed it that the police has filed a final report and the magistrate concerned has accepted the same.
Counsel for the central ministers,Shamit Gopal said,The state government submitted before the court that a final report has been filed by the police and the same has been accepted by the authorities concerned. Therefore,the cause of our petition had become infructuous. Accordingly,it was disposed of.
Prem Prakash,counsel for the student leader Abhishek Yadav,on whose complaint the FIR was registered against the ministers,said,The police has filed a final report and,accordingly,the petition was disposed of. It is up to the client to decide future course of action.
On November 14,2011,during Rahuls rally in Jhunsi,Yadav had broken through the security cordon to show black flags to the Congress leader,as he was delivering his speech. While the security personnel had managed to catch him,central ministers Prasada and Singh,besides the then Congress Legislative Party leader Pramod Tiwari and MLC Naseeb Pathan had allegedly assaulted Yadav. The FIR was registered at Jhunsi police station in this connection. Subsequently,the ministers and other leaders had approached the Allahabad High Court,which had stayed their arrest.
