HC allows CPM MLA to file police complaint on House assault

The Calcutta High Court today allowed CPM MLA Gauranga Chatterjee to lodge a police complaint on an incident in which Chatterjee and another party MLA were allegedly beaten up by Trinamool Congress MLAs in the Assembly in 2012.

The Calcutta High Court today allowed CPM MLA Gauranga Chatterjee to lodge a police complaint on an incident in which Chatterjee and another party MLA were allegedly beaten up by Trinamool Congress MLAs in the Assembly in 2012.

On December 7,2012,Chatterjee and Debolina Hembram were allegedly beaten up by Trinamool Congress MLAs but Speaker Biman Banerjee did not take any step against the latter after the incidents. Chatterjee had to be admitted to SSKM hospital and was later shifted to a private nursing home.

Delivering the order,Justice Dipankar Dutta also said Chatterjee can file a case against the SSKM hospital on grounds of medical negligence.

Earlier,Chatterjee had filed a writ petition alleging that the Speaker should have lodged an FIR against the MLA who had assaulted him in the House. The Advocate General of the state argued that the High Court cannot intervene in the proceedings of the Assembly.

In his petition,Chatterjee alleged that the SSKM hospital did not treat him properly.

Justice Dutta today said that Chatterjee could have died of his injuries,adding that according to Article 212/1,Chatterjee has the right to lodge a complaint with the police on the incident. It was expected that the MLAs would behave properly in the Assembly and the Speaker of the Assembly acted as a responsible person of the House,said Justice Dutta.

The CPM MLA said he would lodge a complaint with the police according to the order of the High Court.
