More than a year after the death of Amity student Justin John Xavier due to drowning at the university swimming pool in Noida,the case has been transferred to the Central Bureau of Investigation (CBI) by the Kerala High Court. The investigators,in their statement,told the court that further probe was needed as the first autopsy performed in Noida was not proper.
Talking to Newsline,Justins father John Xavier said the family wants a detailed investigation. My sons height was 184 cm,more than the depth of the pool. He was also an excellent swimmer. He had told us some senior students were ragging him,he had complained about it but to no use. We asked for a second autopsy as we were not satisfied with the first. In a writ petition we had asked for detailed probe.
Responding to the petition,Circle Inspector (CI) of Pattimattom filed a statement in which he said Justins death was registered as unnatural death. After obtaining permission from the District Magistrate,the body was exhumed and a second autopsy was performed in October last year by a team of doctors led by Dr Sreekumari,police surgeon,Alappuzha Medical College. It was found that the first autopsy performed at the government postmortem centre,Noida,was not done properly. A detailed examination of the internal organs was not done, the CI stated.
The respondent also briefed the court on the antemortem injuries observed on the body.
Justice V Ramkumar noted that there were a few missing links and grey areas which have to be cleared and on September 17 ordered the case in-charge to forward the case to the Director,CBI,directing the latter to submit a report within eight months from the date of receipt of the copy of the judgment.
