Luxury car dealer told to provide free repair within warranty period

Chandigarh Consumer Disputes Redressal Forum-I has directed a leading car manufacturer and the local dealer to repair the luxury vehicle of a Zirakpur resident under warranty and make it fully roadworthy,without any charge.

President of the Commission P D Goel and Members Rajinder Singh Gill and Dr Madanjit Kaur Sahota have also directed the manufacturer and the dealer to pay Rs 40,000 to the complainant as compensation for harassment,and litigation cost of Rs 10,000.

In his complaint made to the Forum,Taranjeet Singh Warar stated that in August 2008,he purchased a luxury car from the dealer in Industrial Area,Phase I. The vehicle started giving problems soon after purchase. Despite leaving the vehicle at the dealer’s workshop repeatedly,the defects could not be fully removed.

Warar complained that the dealer did not show him the report of the Technical Engineer of the manufacturer,who had supposedly inspected the vehicle in November 2009.

Warar said that since the vehicle was within the warranty period,the repairs should have been carried out for free. But the dealer handed him a bill of Rs 2.20 lakh for the repair. He stated that even though he informed the insurance company that he had left the vehicle in the dealer’s workshop,the company did not appoint a surveyor on the pretext that there was a manufacturing defect.

The manufacturer and the dealer stated that the complainant had already taken an accident claim for the vehicle. Due to the impact,the vehicle had not been working properly. Hence the warranty clause was not applicable. The insurance company said that the complainant did not inform them about having the vehicle at the workshop and a surveyor was not appointed.
