Chief Justice assures Gurgaon resident that his case will be listed for an early hearing

Hands folded,tears rolling down his cheeks,a 65-year-old man today knocked on the doors of the Punjab and Haryana High Court begging for justice. His only plea was that his case challenging his premature retirement,pending for the last seven years,be heard before he dies. “I do not want to die. I still have to get my daughter married,” said Hukumat Rai,a resident of Gurgaon.

Old and down,Rai has no one to look after him. “My wife died four years ago,I have attached her death certificate with the application to prove the veracity of my claim. My only request is that a decision be taken in my case. If the judgment is in my favour,I’ll have some money to arrange for my daughter’s wedding. If not,I’ll have to think of other means of arranging money. I don’t want to raise a loan from anyone,” said an inconsolable Rai.

The lawyers advised Rai to put forward his request to Chief Justice Mukul Mudgal after the lunch break. But the CJ,even before Rai could muster the courage to make the request,enquired about the old man standing in open court from his staff.

Rai apprised Mudgal about his condition and requested for an early hearing.

Mudgal assured him that his case will be decided with an immediate effect. Thanking the Chief Justice,Rai returned home with a smile on his face. “Chief sahib ne bola hai ki woh karwa denge (The Chief Justice has assured me that he will get the case listed for an early hearing),” said Rai.

Employed as an assistant superintendent in the Employment Exchange at Rohtak,Rai was to retire from service in 2003.

In 1998,a senior made a few adverse remarks against Rai in his annual confidential report. However,despite the adverse remarks,Rai was promoted to the post of deputy superintendent.

“I was forced to retire in 2001 on the ground that adverse remarks were made against me in 1998. If this is the reason,why did they promote me later? I want that my premature retirement be set aside and the salary and benefits of two years be paid to me,” said Rai.

He had challenged his premature retirement on January 14,2002,but the case still remains undecided.
