A voluntary organisation has moved a public interest litigation (PIL) before the Gujarat High Court (HC) seeking directions to the central government to establish a Green Tribunal in Gujarat.
The court issued notices to the concerned respondents to the petition and kept it for further hearing in two weeks. The petitioner,Consumer Protection and Analytic Committee in Ahmedabad,has named the central government and the National Green Tribunal as respondents to the petition.
According to the petitioner,under the National Green Tribunal Act,2010 five benches of the tribunal have been established in different parts of the country. The benches are in New Delhi,Pune,Kolkata,Chennai and Bhopal. Under the provisions of the said act,the Pune bench of the tribunal has the jurisdiction over Gujarat and any petition related to the tribunal in Gujarat has to be filed before the bench at Pune in Maharashtra.
The petitioner has stated that giving the jurisdiction of Gujarat to a bench based in Pune was unconstitutional and it would benefit the industries as there would be lesser petitions filed due to the distance between Pune and Ahmedabad.
