CIC’s post vacant for a year, HC seeks Centre’s reply

The Delhi High court on Wednesday asked the Centre to file its reply by Thursday on why the post of the chief information commissioner (CIC) of India has been vacant for almost a year.

“Additional Solicitor General should inform the court what steps have been taken to fill up the position,” said the court of Chief Justice G Rohini and Justice RS Endlaw. The directions were issued on a PIL filed by three RTI activists, who have alleged that the post of CIC and three other central information commissioners have been lying vacant for several months, leading to a huge buildup of pending cases.

According to the petition, due to non-appointment of the CIC and the three information commissioners, the pendency at CIC is currently 37,650 appeals/complaints. About 13,615 appeals and complaints are pending for disposal before the bench of CIC himself, which includes cases of important authorities. Further, since the CIC is responsible for administrative functions and allocation of cases, some matters have not been heard for 2-3 years, alleges the PIL.

According to the plea filed by RK Jain, Commodore Lokesh Batra and Subhash Chandra Aggarwal, two posts of central information commissioners were vacated in February 2014, and advertisement for appointment were taken out. In August 2014, the then Chief Information Commissioner Rajiv Mathur, as well as another information commissioner also retired, leaving the posts empty.
