
Pak terrorist Mohammad Ajmal Kasab could finally get a lawyer to argue his case. The Maharastra State Legal Services Authority (MSLSA) is ready with a list of lawyers, one of whom could eventually defend Kasab, if the trial court agrees.
“Under our Constitution, everybody, including foreigners, is entitled to proper legal assistance. If the court agrees, we will certainly provide legal assistance to Kasab. And, in case, we don’t find any lawyer in Mumbai ready to take up his brief, we will even consider bringing in a lawyer from some other state,” said K K Sonawane, Secretary, MSLSA.
Sources said two lawyers on the panel of the Mumbai district committee of the Authority have already been sounded.
Many lawyer organisations have directed their members not to take up his case. Sometime back, the Bombay Metropolitan Magistrate Court’s Bar Association passed a resolution to this effect. The Shiv Sena has also warned lawyers against representing the terrorist. Attempts by at least two lawyers have met with stiff resistance.
“The trial would be vitiated if he (Kasab) is not provided legal assistance. We will wait if the Pakistan High Commission, to which Kasab has written, does something. Otherwise, we are bound to give legal assistance to him. This is necessary under the principles of natural justice, which provide for free and fair trial. Once the trial starts, our lawyer will certainly be there,” Sonawane said.
