Refusing to commit himself to the controversial premature release of Nalini Sriharan, who is serving a life sentence in the Rajiv Gandhi assassination case,Tamil Nadu Chief Minister M Karunanidhi said on Wednesday that the issue would be discussed at national level before a final decision was taken.

In such cases of national importance, the state government cannot take a decision on its own. It will be discussed with the Centre before a final decision is taken, Karunanidhi.

The issue has got mired in political and legal tangles with Janata Partys Subramanian Swamy and Congress8217;S V K S Elangovan opposing Nalinis release. Nalini has been been behind bars for 19 years now.

Swami has petitioned the Madras High Court that the prison advisory boards recommendation, which it has already submitted to the state, should not be considered till his plea challenging Nalinis right to demand a second pardon for the same case Nalini was on death row before the sentence was commuted to life in prison was not disposed.

The board, constituted after Nalini approached the Madras High Court, has reportedly given a favourable report in her case. It has, however, stressed the report was only recommendatory in nature. It is merely suggestive and not binding on the government. The authorities can decide whether to accept or reject the report, said a source.
