The CBI has filed a closure report in the Rs 60 lakh bribery case against Delhis former central excise commissioner Anup Kumar Srivastava. The agency had also booked Srivastava in a disproportionate assets case in early 2012. It was then alleged that Srivastava demanded a bribe for shielding two businessmen in a tax evasion of Rs 2 crore.
Srivastava has reported back to work.
The agency claimed that the case against Srivastava was closed after the Delhi HC orders which quashed the charges framed by a special CBI court against him on the chargesheet filed by it. The case against four others who were booked along with Srivastava is still in trial stage. The agency failed to convince the court with the evidence collected against Srivastava. The CBI was also criticised for not obtaining a prosecution sanction before filing chargesheet.
Speaking to The Indian Express,Srivastavas lawyer S K Rungta said,There was no evidence against Srivastava and the CBI falsely implicated him. The prosecution case against Srivastava was even not supported by CBI witnesses during the trial.
A CBI spokesperson said the orders of the HC is being analysed for appeal before a higher court.
