The CBI on Tuesday opposed the plea of former telecom minister A Rajas personal secretary R K Chandolia that the agency did not have proper sanction to prosecute him in the 2G case. In its reply before Special CBI Judge O P Saini,the CBI said Chandolias plea is frivolous and should be dismissed with imposition of heavy cost.
Chandolia had accused the CBI of not having any sanction under the Delhi Special Police Establishment Act to probe the case against him. The CBI countered that Satish Bhushan,Under-Secretary vigilance,Ministry of Finance,had conveyed permission of the government as required under the Act.
The CBI said they did not require sanction for his prosecution under the IPC as allegations levelled in the charge sheet are self-explanatory.
Opposing Chandolias plea for interim bail,CBI said: There is no provision in the CrPC8230; entitling an accused to be released on interim bail till disposal of application,challenging authenticity of sanction order.
