CBI filed a final report in a special court in Lucknow Thursday requesting discharge of all five accused,including former Uttar Pradesh minister Raghuraj Pratap Singh alias Raja Bhaiyya,in the murder of DSP Ziaul Haque.
The agency said during investigation,no evidence came on record to prove their presence at the place of occurrence at the relevant time.
Haques wife Parveen Azad had lodged a police complaint against Raja Bhaiyya and his aides,based on which an FIR was registered. She accused Gulshan Yadav,Hariom Srivastava,Guddu Singh and Rohit Singh of killing Haque,then circle officer of Kunda,at the behest of Raja Bhaiyya.
Haque had gone to Balipur on March 2 evening to probe the murder of village pradhan Nanhe Yadav when he was killed.
The CBI said Azad admitted that her knowledge of the incident was based on hearsay. She said Haque had told her he was facing interference in his day-to-day functioning and threats from the accused. She specifically mentioned cases of illegal sand mining at Gotni Ghat in Kunda sub-division.
CBI said despite a thorough investigation no evidence could come on record to substantiate the allegations.
The agency cited the opinion of Central Forensic Science Laboratory on a polygraph test Raja Bhaiyya took. It said no deception was found in his replies to the 20 questions he was asked about the murder of Haque.
The court has sought objections to the final report from Azad by the next hearing on August 14.
Raja Bhaiyya had resigned as Food and Supplies Minister a day after he was named in the FIR.
CBI has already filed a charge sheet against 14 persons based on another FIR registered on the complaint of then station officer of Hathigwan Manoj Shukla. The charge sheet says village pradhan Nanhes son Yogendra shot Haque with his fathers licenced .315-bore rifle.
Raja Bhaiyya,meanwhile,claimed there was conspiracy to frame him. I will not name those behind it but will file a defamation case after discussing it with my supporters. I had said from the beginning there cannot be two FIRs in a case.
I knew I was innocent but resigned from the cabinet keeping in mind the image of Samajwadi Party SP and Chief Minister Akhilesh Yadav.
Asked if he would demand reinstatement in the cabinet,Raja Bhaiyya said: It is up to the SP leadership to decide.
