I bought a property in Bangalore,which comes under BBMP Bruhat Bangalore Mahanagar Palika. Since I have taken a bank loan,my original agreement and documents are with the bank. I have not prepared the Khatha yet. What is the procedure to be followed for this ?

You would need the Index-2 as proof of registration of your agreement with which you can apply to the concerned authorities. It is highly advisable to employ the services of a local lawyer who is conversant with the procedures.
I have a flat in a residential society in Lonavala which I have sublet for three years. The society secretary is insisting that I pay non-occupancy charges at half the rent that I receive. Am I bound to pay this exorbitant charge?

As per the circular issued by the Co-operation and Textiles Department,non-occupancy charges cannot exceed 10 per cent of the service charges and that too only if the house is sublet. You are therefore not bound to pay this illegal demand. Put this on record by writing a letter to the society and warn the secretary that you will take suitable legal action against the society and him personally if he continues to misuse his position.
My brother has a duplex flat,in a society in Indirapuram and wants to sell the upper portion of the flat. Can he do so legally?

A unit cannot be subdivided and sold off as a member holds shares in the society and has occupancy rights in relation to the unit. The rule is one unit one owner. Subdivision and sale would not be correct as it would violate the
approved plans as well.
