
CHANDIGARH, JUNE 14: Issuing notice of motion for August 11, the Punjab and Haryana High Court today stayed the operation of a resolution appointing Shiromani Gurdwara Parbandhak Committee secretary Kulwant Singh as the secretary of the managing committee of General Shivdev Singh, Dewan Gurbachan Singh, Khalsa College at Patiala.
Pronouncing the orders in the open court, Justice H.S. Bedi and Justice J.S. Khehar also stayed the operation of an order appointing SGPC joint secretary Ajaib Singh as the additional secretary.
Seeking the quashing of the resolution dated April 28 and order dated May 25, petitioner Karnail Singh 8212; secretary of the Khalsa College managing committee 8212; stated that the appointments were quot;illegal, unlawful and contrary to the rules and regulations framed under the Sikh Gurdwara Act, 1925quot;.
The counsel for the petitioner, M.L. Saggar, stated that the appointment of Bibi Jagir Kaur as president of the managing committee was also quot;illegal, unlawful and contrary to the rules of the education committeequot;.
The counsel stated that quot;there was no post of additional secretary and there was no provision for the appointment of the secretary of the managing committeequot;.
The counsel further submitted that quot;two presidents of the local managing committee was causing a lot of interference in the running of the college affairs, besides the operation of bank accountsquot;.
Going into the background, the counsel stated that on May 7, a letter from the SGPC secretary was received by the managing committee secretary quot;mentioning that Bibi Jagir Kaur would be the committee presidentquot;. On May 25, the SGPC secretary informed the college that Ajaib Singh had been appointed as the additional secretary, he had added.
Anticipatory bail plea rejected
The anticipatory bail plea of a Faridabad resident was today dismissed by the Punjab and Haryana High Court in a cheating and forgery case.
Pronouncing orders on the petition filed by Manju Shree, alias Manju Duggal, Justice V.M. Jain observed: quot;After hearing the counsel for the petitioner and going through the record, including the order dated June 3, 1999 passed by the Sessions Judge, Faridabad, I find no ground to order the release of the petitioner on anticipatory bail.quot;
The petitioner had earlier applied for bail following the registration of a case against her quot;employeequot; Sunil Bahal with the Police Station Central at Faridabad under Sections 420, 467, 468, 471, 171 of the Indian Penal Code.
Complainant Sanjay Aggarwal 8212; chief executive officer of Sun City Project Limited 8212; had alleged fraud by Sunil Bahal in the name of World Bank and Asian Development Bank. He alleged that Bahal claimed quot;to assist them to access ADB funds and had made them apply on what turned out to be fake stationary and formsquot;.
