
The Supreme Court on Friday refused to hear a petition against Lalu Prasad challenging his continuance as Union Minister over issues relating to contesting elections, saying it was filed to seek 8220;publicity8221;.
8220;We will not consider it. We will not hear it. The petition is not maintainable,8221; a Bench headed by Chief Justice K G Balakrishnan said. 8220;The petition was filed seeking publicity,8221; the Bench observed.
The petition sought a stay on the appointment of Lalu as Railways Minister contending that his continuance was unconstitutional on the ground he had contested Lok Sabha election from Chapra while being member of the House from another parliamentary constituency.
The petition, filed by advocate P C Sharma, sought to raise the question whether a Lok Sabha or Vidhan Sabha member can contest the election for the same House, despite coming from another seat.
