PUNE, Nov 6: Third extra joint district judge, Pune, has today sent a letter to the superintendent, Nagpur Central Prison, telling him to release Pandit Onkar Sapkale, accused in the Jalgaon sex scandal, as per the order of the Bombay High Court and certify the execution of the order by endorsing the writ within two days of receipt.

Sapkale was convicted by the joint district and additional sessions judge, Pune, on May 30, 1995 for offence punishable under section 376 (1) of the IPC and was sentenced to seven-year RI and a fine of Rs 6,000.

He made a criminal appeal in the High Court. The high court on November 3, set aside the conviction and sentence recorded by the sessions court and securing the release of the accused. Advocate Shrikant Shivde appeared on behalf of the accused.

The high court has ordered that the accused be released forthwith if not required in any other case. Fine if paid is to be refunded to him. The sessions court has ordered the Nagpur Central Prison superintendent to carry out the execution order by discharging Sapkale if not required in any other case.
