
The HRD Ministry says that since the IIM Society has not made any by-laws, whatever fees IIM Ahmedabad has charged the last 40 years is illegal. This flies in the face of two key facts:
8226; Firstly, it8217;s not just for fees, there are no bye-laws for anything, not even for the institute8217;s fellowships and scholarships.
8226; Secondly and more importantly, rules framed right at the inception delegate all powers for running the institute to its Board of Governors.
Rule No 4 of the Society categorically says: 8216;8216;The general superintendence, direction and control of the affairs of the Society and its income and property shall be vested in the governing body of the Society, which shall be called the Board of Governors 8230;8217;8217;
Thus, contrary to the HRD Ministry8217;s claim, the Board has the discretion under Rule 4 to fix fees without taking the approval of the Government.
Also, the steady increase in it over the last 10 years to the current level of Rs 1.50 lakh per year has been entirely because of the Government8217;s acceptance of the Kurien report to reduce the subsidies at IIMs.
