
CHANDIGARH, JUNE 8: Issuing notice of motion, a division bench of the Punjab and Haryana High Court here has ordered that Rajpura tehsildar Subhash Chander Bhardwaj will not be reverted quot;in case there are vacanciesquot;. Pronouncing the orders in the open court, the bench comprising, Justice H.S. Bedi and Justice J.S. Khehar observed: quot;In case there are vacancies available as contended by counsel for petitioner, the petitioner will not be reverted from the post of Tehsildarquot;.
Counsel Anil Malhotra had stated that it was unnecessary to revert the petitioner as there were quot;eight posts of sub-registrars and three posts of tehsildars against which the petitioner could be promotedquot;.
Earlier, seeking the quashing of an order quot;whereby the petitioner was sought to be reverted to the post of naib tehsildarquot;, Bhardwaj, in his petition, had stated that the action was quot;in contravention of the provisions of the Punjab Tehsildars Class II Service Rules, 1984quot;.
And the order quot;had been passed without any determination of the joint seniority lists of naib tehsildars in all divisions after retention of six junior personsquot;. The counsel had also submitted that the Patiala Commissioner had recommended the petitioner for promotion in May 1996. He had further submitted that in March 1999, a show cause notice was issued to the petitioner quot;seeking to revert the petitioner to naib tehsildarquot;.
