CHANDIGARH, Feb 26: Arguing over the bail application (FIR 1) of K.K. Jerath in the court of UT District and Sessions Judge B.S. Bedi today, the counsel for Jerath submitted that the entire case was based on documentary evidence already taken into possession by the prosecution, and on this ground alone the petitioner deserves to be released on bail.

Orders on the application will be announced tomorrow.

The defence counsel stated that the case against the petitioner had been registered at the instance of Anuradha Gupta, Chief Vigilance Officer, who is also in-charge of the investigation.

He stated that some persons whose names figure in the diaries have not yet been arrested or suspended. In case of Gilhotra who surrendered very recently, the prosecution did not even ask for police remand, he said.

It was added that in FIR No. 3, eight people had been arrayed as accused but only Jerath was arrested and suspended. In fact, bail application of other identically-situated accused was allowed.

Meanwhile, the prosecution stated that the alleged accused had been a proclaimed offender and would again abscond if enlarged on bail.
