CHANDIGARH, MARCH 22: Dismissing former UT chief engineer K.K. Jerath8217;s bail application, Justice R.L. Anand of the Punjab and Haryana High Court today observed that quot;this court would like to monitor the prosecution of the case before the trial courtquot;.

Pronouncing the orders, Justice Anand observed in the open court: quot;During the course of submission, it was stated before the court that the prosecution in this case is not honest. In spite of the fact that there are 37 accused, still the prosecution is not inclined to arrest 21 accused, though sufficient evidence has been collected against them.quot;

Directing the prosecution to take a positive stand regarding the 21 accused, Justice Anand added: quot;If the investigating agency wants to arrest those persons, it shall proceed according to lawquot;.

Dismissing the application, Justice Anand observed: quot;I am of the opinion that the petitioner does not deserve the concession of bail, keeping in view his past recordquot;. Justice Anand, however, permitted Jerath to file a fresh bail application in the High Court quot;after a period of three months from todayquot;.

Jerath had surrendered before a city magistrate8217;s court on November 27 after being booked by the UT Vigilance Department under the Prevention of Corruption Act, besides Section 406, 409, 420 and 120-B of the Indian Penal Code on February 3, 1998.

According to the prosecution, his name was mentioned in certain diaries allegedly recovered from the residences of the alleged middlemen during a raid by the Income Tax authorities in November 1997.
