CHANDIGARH, June 12: Superintending engineer Jagdish Mitter8217;s bail plea will come up for arguments before UT District and Sessions Judge B.S. Bedi on June 16.

An accused in the Engineering Department kickback case, Mitter was arrested by UT Vigilance Department under the Prevention of Corruption Act on June 3.He is the ninth accused to arrested in the case on basis of diaries reportedly recovered during raids by the income-tax authorities at the residence of the alleged middlemen in November last year.

According to the prosecution, approximately Rs 1,75000 were entered against his name in the alleged middleman, Sunil Kalia8217;s diary, while about Rs 85,800 were scrawled against his name in the diaries allegedly belonging to the other quot;middlemenquot;, Sharma brothers.

Meanwhile, seeking his release on bail, the defence counsel contended that the accused was being falsely implicated in the case. His name was neither mentioned in the FIR, nor in the diaries recovered from the residences of the alleged middlemen, the counsel stated.

The evidence against Mitter was fabricated. The enteries against his name were made during police remand of the alleged middlemen, taken under the pretext of getting the diaries decodified, he further stated.Mitter8217;s name would have been mentioned in the FIR had the enteries been made against his initials or name. Moreover, nothing incriminating was recovered during the raid on his residence, he added.

Mitter had been joining the investigations before his arrest also. The entire record was with the authorities and would not be tampered with by the accused.

The prime accused in the case, former UT chief engineer K.K. Jerath had been declared a proclaimed offender.
