The District Consumer Forum directed Mahindra and Mahindra and an automobile shop to pay Rs 10,000 as compensation for supplying a faulty Scorpio with defective accessories.

The complainant, Jagmohan Bansal, had purchased a Scorpio Turbo from Swami Automobiles in 2006. He also paid an extra amount of Rs 1,01, 340 for additional modifications and the total sum thus paid was Rs 9,09,990.

It was alleged that one day, while getting his vehicle serviced, Jagmohan came to know that the chassis of the vehicle was not new and had been repaired. He then alleged that he had been delivered a repaired vehicle.

He also said that the vehicle was neither modified by the company nor the accessories fitted.

Mahindra and Mahindra in its reply pleaded that the complainant was not entitled to any refund as he had not submitted any evidence to support his complaint. It was also asserted that his claim was frivolous.

Swami Aotomobiles, in their reply, said the complainant chose the accessories after purchase of the vehicle and got them fitted later.

The forum said that the manufacturing defect pointed out by the complainant was that there were cut marks inside the rear mud guards of the vehicle. The matter was referred to a professor and head of

Mechanical Engineering department of Punjab Engineering College, who said that the inner side of the rear mud guards had been welded.

The forum said there is no evidence to suggest if cutting and welding of the mud guards was necessary or if it exists in other vehicles also, as said by the opposite party.
