Jerath8217;s bail plea rejected

CHANDIGARH, JUNE 29: The bail application of K.K. Jerath, booked here on March 16 under Sections 13 1, C, 2 and 15 of the Prevention of Coruption Act, 1988, along with Sections 409, 120-B and 511 Indian Penal Code, was rejected today by UT District and Sessions Judge B.S. Bedi.

Arguing over the bail application, the counsel for Jerath stated that the subject matter of FIR No. 1 of 1999 had already been covered in FIR NO. 3 dated October 26, 1998, in which the applicant was already under trial. He also mentioned the grounds on the basis of which the applicant was said to have been involved in criminal conspiracy:

  • Highly inflated estimates of works were prepared by the department.
  • Preferential treatment was shown to Yashpal Saggi in allotment of works of GMCH-32.
  • XLPE cables of different specifications were available in the market at lower rates but the department allotted cable work at double, triple prices.
  • Allotment of work to Sawhney was delayed on flimsy grounds to favour Saggi.
  • The counsel also stated that this FIR was a reproduction of the inquiry report submitted by Deputy Home Secretary Sanjeev Khirwar on June 16, 1998. This inquiry was conducted on the complaint of J.S. Sawhney. He added that copies of complaint of Sawhney, report of Khirwar and estimates of works of 11 kv independent feeder had been attached with the supplementary challan of FIR No. 3 submitted in court on January 14, 1999.

    The prosecution kept denying that the matter pertaining to preparation of highly inflated estimates of works by the department had been covered in FIR No. 3 and stated that the accused, if enlarged on bail, might try to tamper with evidence. It was added that the investigation was at an initial stage and statements of witnesses were to be recorded.

    Visa fraud: Bail denied to accused

  • The bail application filed by the visa fraud accused Rajni Hans here on June 23 has been declined by UT District and Sessions Judge B.S. Bedi.
  • Rajni, who was booked on December 31, 1997, was arrested by the city police on June 17 and was earlier remanded to police custody for two days.

    On June 20, her bail application was taken up in the court of City Judicial Magistrate Ist Class A.K. Bishnoi who declined the same observing: quot;Huge sum is involved in the matter and the allegations are of a serious nature. Investigation is also in the initial stage and the accused was a proclaimed offender.quot; After declining the bail application, the Magistrate had remanded the accused to judicial custody till July 3.

    During arguments on the bail plea, counsel for the accused requested the court to take lenient view of the case and give the concession of bail to the accused who was a woman. It was added that husband of the accused was still absconding and that the applicant was being falsely implicated.It may be recalled that Rajni and her husband were declared proclaimed offenders by the Ilaqa Magistrate here on November 30, 1998. The duo has been charged with cheating people to the tune of lakhs of rupees.
