GUWAHATI, Sept 23: The hearing of the bail petition of arrested Tata Tea General Manager S S Dogra, charged with treason, was postponed further today with a single judge bench of Guwahati High Court referring the case to the chief justice for appropriate order.

The Division Bench, consisting Justice V D Giani, referred the case to Chief Justice Ramakrishna Munialappa as he has no knowledge of Assamese in which the 80-page police case diary is written.

Stating that to appreciate the rival contentions advanced one has to go through the case diary, Justice Giani said that translation of the diary was not possible and desirable at this stage.

Under the circumstances, he said, the matter was being placed before the chief justice. The chief justice, however, did not take up the case today nor did he fix a date for next hearing. The hearing of the bail plea was to come up yesterday challenging the September 16 order of Chief Judicial Magistrate, Kamrup district, remanding Dogra to 14 days judicial custody by rejecting his bail application.

Dogra was admitted in the Guwahati Medical College hospital last night after he complained of hypertension. He had been arrested here on September 15. under Sections 120, 120 a, 121, 121 a and 122 of the Indian Penal Code to be read with the Unlawful Activities Prevention Act.

The Tata Tea executive8217;s arrest was made following a two-day interrogation by a special police team on charges of abetting terrorism in Assam and funding ULFA militants, including their medical expenses, hotel bills and air fares in Mumbai.
