Husband-wife duo remanded in magisterial custody till July 14
The city police on Wednesday arrested Dina Institute of Hotel and Business Management managing director Inderjot Kaur Oberoi and executive director Ajit Kumar Oberoi for allegedly cheating around 44 students of its post-graduate diploma course in business management (PGDBM) to the tune of over Rs 50 lakh. They also filed a chargesheet against the husband-wife duo under Sections 420 and 34 of the IPC for cheating. The two were produced before the judicial magistrate first class (JMFC) court,which remanded them in magisterial custody till July 14.
Observing that students had taken admission in the Undri institute on basis of promises made to them,the court said there was no record to show that the promises were kept. The Oberois,however,denied the allegations. We have followed all rules in running the institute, Inderjot told the media outside the courtroom after the remand order.
It was in February 2009 that 16 students of the PGDBM 2007-09 batch filed a petition in the JMFC Court,alleging that the institute had charged exorbitant fees from them. A year later,more students from the 2008-10 batch joined them. Sub-inspector Nagnath Deokare,who is investigating the case,said,We have received a complaint from 44 students of PGDBM 2007 and 2008 batches of the Dina Institute.
Tara chand,a student of the 2007 batch and one of the complainants said,The institute had charged Rs 3 lakh to Rs 5 lakh as fees for the two-year course,even as the universitys Shikshan Shulka Samiti (fee fixing panel) has recommended not more than Rs 91,400,which itself was raised from Rs 24,000 last year after the Oberois filed an application with the Samiti.
The court had,in March 2009,rejected the anticipatory bail application of Ajit Kumar and Inderjot,after which they filed an appeal in the Bombay High Court,which was also rejected in December 2009. The accused were absconding since then. We arrested them from Senapati Bapat Road on Wednesday, Deokare said.
On Wednesday,the court said the accused had deposited Rs 7 lakh earlier this year as directed by the High Court,to be refunded to students. There is no record that the accused made efforts to refund the remaining amount. This has caused economic losses,mental agony and series of litigations.
Though the course is over for the 2008 batch,the internal examination is yet to take place. A possibility of forcing students to withdraw the complaint cannot be ruled out. The accused does not deserve discretion and should therefore be kept in magisterial custody till July 14, the court said.
