Advocates appearing for Bajaj Auto Limited (BAL),in a written application before a first labour court,sought the dismissal of the statement of striking union Vishwa Kalyan Kamghar Sanghathana on Friday. Advocate Aditya Joshi asked the court of Justice M S Bodhankar to fine the union to the tune of Rs 1 lakh.
The statement was filed in response to an application submitted by the union earlier,asking for a reversal of the courts order to continue with the case without the written statement of the union. In their statement,the company said adequate time was given to the union to appear and file their statement before the court,but it failed to do so within the stipulated time.
They also pointed out that the union had not engaged a lawyer and the court had observed that the union is lethargic and it does not want to prosecute the reference in a proper manner.
The company stated the union had requisite funds and there wasnt sufficient evidence to show that they were unaware of litigation and other costs. Questioning the refusal of the general secretary to accept the documents,the statement pointed that the constitution of the union authorised both the general secretary and the president to accept any paper. Asking the court to reject the petition of the union,the company also asked the court to fine the union.
In its statement,the union said they have been demanding shares of the company since January. The management made no effort to discuss the matter with the shareholders. Therefore,the union had no option but to halt work at the plant, read the statement.
The next date for the hearing has been set for August 7.
