(Representational Photo) SENIOR OFFICERS of the Mumbai Police have denied permission to invoke the stringent Maharashtra Control of Organised Crime Act (MCOCA) against three accused of a family for allegedly gunning down the elder sister of a rape victim, as per court records.
The accused, comprising of a couple and their elder son, allegedly shot dead the 22-year-old woman for following up on the rape case against their younger son.
As per court records, an application was filed by the prosecution contending that the sanction of MCOCA was refused by the competent authority against the accused persons. The application, which was accepted by the special court, sought that the matter be sent back to the 52nd court at Kurla.
In July first week, police invoked MCOCA against the three accused after the rape victim’s sister was shot at on April 29 from a country-made revolver. The accused also attacked her with a sword before fleeing.
As per law, certain criteria have to be met before MCOCA is applied in a case. It was unclear on what grounds the permission was denied by senior officers.
