The Bombay High Court on March 14 granted protection from arrest to Mushrif for two weeks in connection with a probe by the ED. The HC also said that Mushrif had the liberty to approach the special court for anticipatory bail.
Further, it directed Mushrif to appear before the ED when called, following which the former minister appeared before the agency.
On Friday, judge M G Deshpande pulled up Mushrif’s counsel asking why they had approached the court at the last minute and not earlier while the relief was granted by HC more than a week ago. The ED’s counsel said that it will file a reply to Mushrif’s plea by March 29.
Senior advocate Aabad Ponda representing Mushrif argued that the ED was delaying its response to the pre-arrest bail as they intended to arrest Mushrif.
Ponda also sought from the ED to make its position clear if it wanted to arrest Mushrif’s chartered accountant Mahesh Gurav in the case. The ED then agreed to file its response by March 27.
