Former NCP MLA’s driver gets 9 years in jail for firing at guard

A sessions court on Friday sentenced the driver of a former NCP MLA to nine years in jail for attempting to murder a security guard at a construction site in 2016.

On August 19, 2016, Mangesh Waghmare was booked for firing at Anil Bhise, who was also working for NCP’s Milind Kamble.

The police had claimed that the accused used a firearm belonging to the former legislator to shoot at Bhise. The court had relied on testimonies of other staff members of Kamble, one of whom deposed that the accused and Bhise had enmity with each other over their closeness with Kamble.

“It appears from the evidence on record that firearm license issued to PW-11 Milind Kamble had expired much before the date of the incident and it was not renewed. The additional report filed by the investigating agency pursuant to the order of the Court directing further investigation in the matter, indicates that investigating agency had proposed the charge for the offence under… Arms Act against Milind Kamble but they could not get sanction under Section 39 of the Arms Act,” the court said.

The court said that since the allegations are that Waghmare used the firearm of Kamble, he cannot be booked for certain sections of the Arms Act related to license.

It held Waghmare guilty under section 307 (attempt to murder) of Indian Penal Code and a section of the Arms Act for using the firearm.

The accused claimed that there were many discrepancies in the probe and he was falsely implicated.
