A special court on Tuesday rejected an application filed by gangster Abu Salem, seeking directions to Maharashtra prison authorities to give a tentative date of his release. Salem is currently serving life imprisonment in two cases–- the 1993 Mumbai serial blasts and the murder of a builder.
In July 2022, the Supreme Court had said that Salem, who was extradited from Portugal in 2005, has to be released after he completes 25 years in jail, as was agreed upon by the Government of India, during his extradition. The special court, while rejecting Salem’s plea, agreed with the submissions made by special public prosecutor Deepak Salvi, for the CBI, that since the Supreme Court has given clear directions that he can be released only after completing 25 years in jail, his plea cannot be allowed.
In an application filed before a special court in Mumbai in October, Salem argued that he has spent over 23 years in prison and wants a tentative date of his release and the remission he will be granted as per prison rules, after taking into consideration the total time period of incarceration, including his jail term as an undertrial, then as a convict.
The CBI has argued that he is not entitled to benefit remission, which usually reduces prison term of convicts, as he has to complete 25 years in jail since the day of his extradition to India in 2005, which will be in 2030.
Salem is currently lodged in Nashik jail. The detailed order on the court’s decision is yet to be made available.
