With the nine-week-long investigation of the Delhi Police into the murder of B Tech student Shobhit Modi drawing a blank,his father moved the Delhi High Court on Monday saying that the family had “lost all faith” in the local police. He has requested a CBI probe into the matter.

Shobhit (22),a second-year IT engineering student at Faridabad’s Manav Rachna University,was stabbed to death on May 5 near the gate of his residence in Vasant Kunj,South Delhi,when he was on his way home from DLF Promenade Mall.

The petition,which is likely to come up for hearing later this week after the High Court Registry clears it,has also sought a judicial order to the Delhi Police for immediately handing over all the investigation records to the CBI in order to prevent any tampering with the evidence collected so far.

The petition has also questioned why the investigators had chosen to not record the entire statement of Shobhit’s father,Suraj Modi,in the FIR. It also states that the names of suspects and evidence supplied by Modi were not considered as crucial by the police.

Gaurav Venaik,counsel for Shobhit’s father,told Newsline that the petitioner had approached the court as his last resort for justice.

“The petitioner (Modi) has communicated with the police several times and also wrote letters to personalities like Delhi’s Police Commissioner,Chief Minister,Lieutenant-Governor and to the Union Home Minister,but got no results. It has been more than 70 days and the police have no clue whatsoever,which only goes to show serious flaws in the probe,” Venaik said. All the letters have been annexed in the petition,he added.

“The petitioner has lost all faith in the Delhi Police and wants an independent inquiry. We believe that the police is lenient and also biased against cracking the case,” he said.

Speaking to Newsline,Modi said the court appeared to be the last option to ensure an efficient probe. “Police are still working on 7 to 8 theories. They are yet to discover a motive. What I had given to them as evidence,they considered immaterial and never probed on those lines. How can my family expect justice for my child in such dubious circumstances?” he said.

DCP (South) Chhaya Sharma,however,maintained that there has been no laxity on the part of the investigators. “We have been working towards a breakthrough. We have documented all the records properly and are working really hard to crack this. Rest will be for the court to decide,” she told Newsline.
