Rs 3-lakh fraud: Man given 3 years in jail

Earlier, Maingi was convicted of duping several people in Daryaganj and Nabi Karim.

While sentencing a man accused of cheating, a Delhi court observed that the right to livelihood as a fundamental right cannot be exercised by duping other citizens.

The observation came in a case where Deepak Maingi posed as a bank employee and cheated a person of Rs 3 lakh. Metropolitan Magistrate Pawan Singh Rajawat sentenced Maingi to three years’ rigorous jail term for the offence of cheating and dishonestly inducing delivery of property under section 420 of IPC.

The court also observed that the incident not only led to mental agony, but also caused huge financial loss. The court directed the convict to pay a compensation of Rs 3.5 lakh to the victim, adding that Maingi’s physical assets are liable to be confiscated and auctioned off if he fails to pay the compensation.

According to the prosecution, Maingi posed a bank employee at the State Bank of India branch in Tis Hazari Courts complex and offered to help complainants Pushpa Chaudhary and her father-in-law deposit Rs 3 lakh in the bank. Chaudhary handed over her money to Maingi, who had assured her that the cash would be deposited early. However, after collecting the cash from them, he ran away.

The court also rejected Maingi’s bail plea, noting that the convict may commit similar offence if released on bail.
The court refused to take a lenient view while awarding the sentence and observed that Maingi was a repeat offender and had been found guilty in number of similar cases.
