The Delhi High Court has asked the Delhi Chief Secretary to look into the demarcation of land around the Karbala and the Shah-e-Mardan dargah in Jor Bagh,after the New Delhi Municipal Council (NDMC) told the court that it was unable to implement an earlier order to construct a boundary wall around the Karbala due to a dispute over ownership of land. The court had passed an order to the NDMC for the construction of the wall in 2005. The DDA had then drawn up a demarcation report in 2006. Various petitions regarding the ownership dispute were filed in the High Court by the NDMC,the Waqf Board and residents of the area. Following this,a Delhi High Court bench passed an order in 2012 asking the NDMC to construct the boundary wall. The Residents Welfare Association of the B K Dutt Colony,Jor Bagh,filed a PIL challenging this order. It alleged that the demarcation was an attempt at grabbing of open spaces/parks in and around colony. The dargah committee approached the HC again in January this year claiming that the NDMC was in contempt of court since it had not built the boundary wall. On Monday,the bench of Chief Justice D Murugesan and Justice VK Jain directed the Chief Secretary to examine the matter and submit a report within three months. We are of the view that the issues raised in the application of NDMC involve detailed examination .and such an exercise,which may also involve inspection of the site,cannot be carried out by the court, the judge said.
