Clinics on house plots can provide emergency services

In what will come as a relief to nursing homes in Noida,the Supreme Court on Friday allowed clinics which operate out of residential plots to provide emergency medical services as well.

On December 4,the Supreme Court had directed all commercial establishments including nursing homes to vacate the residential plots they were occupying in violation of clauses of land use. At the time,however,the apex court had allowed doctors who owned homes to run “clinics meant only for consultation”,if they did not exceed 25 per cent of the total area of the residential plot.

On Friday,the court allowed these clinics to run emergency support services including life support systems.

“This comes after the Indian Medical Association filed a petition which sought clarification on what these clinics are allowed to do. While earlier it was thought that it could only be consultation with no additional equipment,now they can be allowed one bed,equipment in the form of life support systems and emergency medical services. Earlier,the Authority would have counted those clinics which have this paraphernalia as a ‘commercial nursing home’ and had,in fact,served notice to them. Now,they will be let off,” a Noida Authority official said.

The official said,“We will now have to look at two things. First,whether these clinics have more than the amount of equipment the SC has allowed today and second,if the size of the clinic exceeds 25 per cent and is used for commercial purposes.”
