The family of an eight-year-old boy,who was allegedly molested by an AIIMS resident doctor, has taken the matter to a metropolitan magistrate court in Saket, alleging discrepancies in the probe.

The family’s lawyer,Satish Sharma, told Newsline,“We have requested the magistrate to record the victim’s statement under Section 164 of the CrPC. It is obvious that the police are trying to shield the accused doctor. Otherwise,he would have been arrested by now.”

In the first hearing of the case on Friday, the magistrate took cognizance of their complaint, and summoned the investigating officer (IO) of the case on March 15 to clarify on the status of the investigation. The statement of the victim will also be recorded at the next hearing in the presence of the IO.

Newsline had earlier reported that police were considering closing the case after experts assessing the child’s psychological condition said he appeared to be “tutored”,and was under the influence of his father. The report, police said, matched the report of a similar evaluation conducted by an AIIMS team. The accused,Dr Shejoy P Joshua, was sacked on the orders of Union Health Minister Ghulam Nabi Azad after an AIIMS internal committee submitted its inquiry report on February 3.

A police officer said,“We are still awaiting the IHBAS report on the doctor’s psychological examination. We will decide on the probe after that.”
