The District Consumer Disputes Redressal Forum,Panchkula,has directed a Delhi-based wedding decoration firm to refund Rs 2 lakh along with interest for deficient services,unfair trade practices which caused immense mental tension,harassment and economic losses to a Panchkula resident.
A complaint was lodged by Pawan Katia of Sector 7,Panchkula in the Consumer Disputes Redressal Forum,saying that he had hired Fernsnpetals Gadaipur,New Delhi for the decoration of his house and the Westwood Resorts at Zirakpur for his sons marriage scheduled on November 14,2010. The house,according to Katia,was to be decorated for five days and the Westwood Resorts for two days.
Katia paid Rs 2 lakhs in advance on September 4,2010 for the decoration with flowers,tents and lights. Katia had to pay a total of Rs 12 lakhs for the service.
The complainant alleged,The flowers,tents and other decorations did not reach on November 9. The company informed me that they had booked another wedding and were not going to do my sons wedding. I later booked a local tent decorator. The company also refused to refund the advance payment.
The President of the Forum,Ashok Kumar Jain and Member S P Singh found the company guilty of deficient services,unfair trade practices. The company is directed to refund the amount of Rs 2 lakh taken from the complainant as advance money along with an interest at the rate of 12 percent per annum from the date of its receipt, the order said.
The company was also directed to grant punitive damages of Rs 30,000 to the complainant and also pay Rs 5,000 to him as
cost of litigation.
