SIT report: Pleas rejected

The Ahmedabad Metropolitan Court refused to accept the applications seeking copies of the report filed in confidence by the Supreme Court-appointed Special Investigation Team

The Ahmedabad Metropolitan Court on Wednesday refused to accept the applications seeking copies of the report filed in confidence by the Supreme Court-appointed Special Investigation Team SIT,till the investigating agency submitted all relevant documents related to the investigation done on a complaint by Zakia Jafri. The SIT was given time till March 15 to give these papers to the court,even as the court held that it would then examine whether the applicants were entitled to access it or not.

The court passed different orders on different applications,confirming that further procedure on the report would be initiated only after SIT submits documents.

SIT has submitted the report and sought time to present material. In such circumstances,it is not reasonable to make SIT submit documents till documents/statements/material submitted are brought on record. Further,on its production,it can be decided on merits if the applicant is entitled to the demand or not. Further,as per the SC order,it has been ordered to give copies to applicant/complainant as per rules and in such circumstances,there is no reason to accept the application under section 91 of CrPC8230;, the order said.
