In a relief to the Rajasthan government,the Supreme Court has exonerated state Chief Secretary S Ahmed and Department of Personnel DoP Principal Secretary Khemraj Chaudhary of contempt charges after noting they had no willful intention to defy the court orders over reservation in promotion policy and providing promotional avenues to general category employees in more than 110 state services.
The SC Bench observed although there has been a delay in implementing previous High Court orders,their effort in this direction seemed to be in compliance.
The apex court by its decisions in two cases,M Nagaraj and Suraj Bhan Meena,had held that if a state wanted to frame rules over reservation in promotion and consequential seniority for reserved category employees,it required to have quantifiable data on backwardness,inadequacy of representation in public employment and overall administrative inefficiency.
We are of the view that despite the delay on the part of the state in giving effect to the observations made in the two aforesaid cases,there was no willful or deliberate intention on their part to defy the orders of this Court, said the Bench.
