SC acquits four in RSS office attack

The Supreme Court ordered the immediate release of four persons sentenced to life imprisonment.

The Supreme Court on Monday ordered the immediate release of four persons sentenced to life imprisonment for blowing up the state headquarters of the RSS in Chennai in 1993,killing 11 persons and injuring five,in the aftermath of the Babri Masjid demolition.

Allegedly part of a group of 18,the four were acquitted after 17 years on a simple disparity in forensic evidence.

The accused confessed to only having bought gelatin sticks,but the crime scene revealed RDX and PETN. No trace of gelatin was found anywhere at the blast site. With the lack of any direct evidence in the form of eyewitnesses,the court concluded that there was nothing to link the accused to the blast.

The SC also felt the trial court had convicted the four to life on a mere suspicion rather than legal proof that they were behind the August 8,1993,afternoon blast,that had brought down the entire three-storied RSS building.

Prosecution could only prove that the appellants had procured gelatin and detonators. But traces of the said explosives couldnt be found from the scene8230; Thus there is clearly no evidence to link the appellants with the explosion, the SC ruled. Suspicion no matter how strong cannot take the place of legal proof,the court reasoned.
