In a shot in the arm for the Rajasthan Anti Corruption Bureau (ACB),the state advocate-general (AG)s office recently decided to allocate all ACB cases to a single additional AG in an attempt to put up an effective prosecution.
According to ACB records,a copy of which is available with The Indian Express,109 cases involving high-profile government officials,have been stayed by the Rajasthan HC in the last few years.
On Wednesday,a group of lawyers and concerned citizens under the banner of the Forum for Judicial Accountability stated that recent judgment of the Rajasthan HC favoured land dealers,contractors and corrupt officials and had weakened the anti-corruption mechanism and had demoralised upright officials and other individuals by entertaining baseless PILs. The forum also handed the Rajasthan Chief Justice a memorandum in this regard and sought an in-depth investigation into such cases.
Rajasthan AG G S Bafna confirmed that ACB cases were in the process of being allocated to a single additional AG. This move might help get the cases moving, Bafna said. He added that an additional AG had been allocated all ACB cases in the Jaipur and Jodhpur benches of the Rajasthan HC.
Advocate A K Jain,who is part of the Forum for Judicial Accountability,asserted that the Supreme Court had clearly laid down that ACB cases should not be stayed. The Supreme Court in the Satya Narayan Sharma case has laid down that no proceeding regarding ACB cases can be stayed but only quashed, Jain said.
