‘No criminal case against lawyers for wrong advice’

The apex court said that professionals like lawyers,doctors and surgeons cannot be expected to give a 100 per cent assurance to their clients or patients of success.

The Supreme Court on Friday held that lawyers cannot be subjected to criminal prosecution for monetary losses to their clients due to their advice unless it was established that they had colluded with others to cause the loss.

The apex court said that professionals like lawyers,doctors and surgeons cannot be expected to give a 100 per cent assurance to their clients or patients of success.

“The only assurance such a professional can give or can be given by implication is he is possessed of the requisite skill in that branch of profession

he is practising and while undertaking the performance,he would be exercising his skill with reasonable competence,” said a Bench led by Justice P Sathasivam.
